TERMS AND CONDITIONS
1. “We” and “us” means Strawberry Field (The Salvation Army Trustee Company as trustee of the Salvation Army Social Work Trust).
2. “You” and “your” means the person who is paying to submit a photo for use in the photomosaic on display at Strawberry Field, Liverpool.

4. The price to submit a photo for the photomosaic (if we accept the photo – see below) is £75.
5. How to order / how we can reject photos: You can pay at our store in Strawberry Field, Liverpool or at our online store website. Once you have paid, we will send you a link to upload your photo. (If you pay for more than one photo, you will be sent more than one upload link.) You should upload your photo(s) within the month of your payment. We will review each photo and check its suitability in line with clause 9. If we reject your photo, we will notify you and invite you to submit a replacement photo within 5 days. If you do not submit a replacement photo which is accepted before 31st March 2025, we will automatically cancel your contract (in relation to the relevant number of photos) and issue with a refund as explained below. If we accept your photo, we will send you an email confirmation. There is no guarantee that we will accept your photo, but if we do not, we will refund you, as explained below.
6. Please submit a digital image with a minimum file size of 1.5MB/300DPI. - ideally, the image should be a head and shoulders shot of 1-2 people. Any more people included in the image could impair the quality of your mosaic image. Pictures may be submitted in colour. During the artwork phase these will be converted to black and white.
7. How we can use your photo(s): If we accept your photo, we will use it as part of the photomosaic on display at Strawberry Field, Liverpool for at least 5 years from the launch date in 2025. You acknowledge that your individual photo may not be identifiable within the photomosaic and that you cannot require your photo to appear in a particular place within the photomosaic. We may also use it (still as part of the photomosaic, not separately) for marketing and merchandising purposes relating to our work at Strawberry Field and/or the work of The Salvation Army more broadly. Except for your right to cancel, you cannot require us to stop using, or not to start using, your photo once it has been accepted. We can cut, edit and arrange your photo(s) as we wish, as part of the photomosaic. For example, we can sharpen the image and add more shading and depth. We will not publish your name as part of the photomosaic.
8. Important assurances to us about your photo(s): Before you submit a photo, you must get the permission of the person who took it (otherwise you and we may have problems under copyright law) and, if the photo include images of people, you must also obtain their permission. If the person shown in the photo is under 18, you must also get the consent of that person’s parent or guardian, again before you submit it. An email consent form will be
sent to confirm permission of image use.
9. Our right to reject photos: We may reject any photo on the grounds (a) that it is not of good enough quality; (b) that we think its use may infringe someone else’s rights or may not comply with data protection law; (c) that it amounts to self-promotion or advertising; (d) that it is obscene, unlawful and/or likely to cause offence or embarrassment to any person, group or organisation; (e) that it is incompatible with our principles and values.
10. Your right to cancel: You have the right to cancel within 14 days after the day on which the contract is entered into, which is 14 days after you pay us. To cancel: please send an email to info@strawberryfieldliverpool.com Title – CANCELLATION.
11. Refunds: if you cancel this contract (under clause 10), or if we reject your photo, or if we have not accepted a photo before 31st March 2025, we will issue you with a refund within 5 WORKING DAYS and that will bring an end to our contract with you (for the relevant number of photos). 12. 13. Legal claims: These terms are governed by English law and wherever you live you can bring claims against us in the English courts. If you live in Wales, Scotland or Northern Ireland, you can also bring claims against us in the courts of the country you live in. We can claim against you in the courts of the country you live in.
